McCarthy has been in and out of courts since 2013, when the baby girl, Rehma Sabir, died in Cambridge, Massachusetts. Prosecutors said that Rehma had died after being violently shaken
But Middlesex District Attorney Marian Ryan announced on Monday that the murder charge was dropped because the medical examiner issued an amended ruling changing the manner of death from 'homicide' to 'undetermined'.
Ryan said the medical examiner found Rehma had prior medical issues and may have had some type of undiagnosed disorder.

Several hundred migrants staged an angry demonstration and clashed with police (pictured main and bottom right) following the closure of Keleti station (inset) in Budapest, Hungary. Young men could be heard chanting: 'Germany, Germany', 'We want to leave', and 'Merkel'. It followed the evacuation of the station after scuffles broke out (top right) when desperate families tried to board trains to Vienna, Austria, and Munich, Germany. On Monday, German Chancellor Angela Merkel said the EU's passport-free travel zone was under threat

Manchester City's new £49million signing Raheem Sterling has put his four-bedroom Southport mansion up for sale after his big-money move from Liverpool this summer.
The 20-year-old's detached home - which is on the market for £1.5m - portrays the life of a modern footballer with its own indoor swimming pool, barber's salon, home cinema and even a Michael Jackson-themed bar area.
The bar dedicated to Michael Jackson is equipped with a DJ deck and includes several pieces of memorabilia ranging from photographs of the legendary singer to his trademark leather jacket and fedora trilby hat.
Two Liverpool cushions can also be seen resting on a cream sofa in the starlet's bling-tastic personal salon.

These pictures show the last days of Manchester slum-land when houses built during the 19th century to home workers were finally demolished. Photographer Shirley Baker was the only female photographer documenting British street scenes between the 1960s and the 1980s. Her work featured urban areas in Manchester and Salford at a time of major social change, catching the dying days of a previous era. Ms Baker captured images of people living in the densely-packed terraced houses in inner-city Manchester - similar type places to that depicted in Coronation Street. The photographs showed youngsters at play and their mothers standing outside talking in communal groups, something that would appear very strange to modern society.
